Rothschild Mental Health Counseling, PLLC (“we,” “us,” or “our”) is a licensed mental health counseling practice providing telehealth psychotherapy to persons present in New York State at the time of services. This Privacy Policy explains how we collect, use, and protect information gathered through this website (rothschildcounseling.com), and the choices you have.
Important — this website policy is not our HIPAA notice. Protected health information (“PHI”) that we create or receive in the course of providing counseling — including anything in your clinical record — is governed by the federal Health Insurance Portability and Accountability Act (“HIPAA”), New York’s mental-health confidentiality law (Mental Hygiene Law § 33.13), and our separate Notice of Privacy Practices, which we provide to clients. Please do not include detailed health information in the website contact form; use our secure client portal or contact the office directly for anything clinical.
1. Information We Collect
We collect only what we need to respond to you and operate this website:
- Information you provide: your name, phone number, email address (if given), and the contents of any message you submit through our contact or job-application forms.
- Appointment requests: if you book through a third-party scheduler (Zocdoc) or our client portal, that information is collected by those providers under their own privacy policies.
- Device and usage information: such as IP address, browser and device type, and pages viewed, collected through cookies and similar technologies (see Section 5). Optional analytics are collected only with your consent.
- SMS consent data: your opt-in status, the date and time of consent, and the associated phone number, to comply with the Telephone Consumer Protection Act (TCPA).
If you voluntarily include health-related details in a message to us, we treat that information as confidential.
2. How We Use Your Information
We use information collected through this website to:
- Respond to your inquiries and help you schedule or begin care;
- Send SMS messages you have consented to receive;
- Operate, secure, and improve the website;
- Comply with our legal, professional, and regulatory obligations.
We do not use website information to make treatment decisions, and we do not sell your personal information.
3. Protected Health Information (HIPAA & New York Law)
As a healthcare provider, we are a HIPAA “covered entity.” PHI in your clinical record is used and disclosed only as permitted by HIPAA and New York law — generally for treatment, payment, and healthcare operations, or with your written authorization. New York provides heightened protection for mental-health information, and certain categories (such as HIV-related information, substance-use records, and psychotherapy notes) receive additional protection and typically require your specific authorization to disclose. Your full rights regarding PHI — including the right to access and to request amendment of your records — are described in our Notice of Privacy Practices. Where a third-party vendor handles PHI on our behalf, we enter into a HIPAA business associate agreement as required by law.
4. SMS/Text Messaging Terms
By providing your phone number and opting in to receive SMS messages, you agree to receive appointment reminders, scheduling, care coordination and other relevant text messages. Message frequency varies. Message & data rates may apply.
You can opt out at any time by replying STOP to any text message we send. You may also reply HELP for help.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
5. Cookies and Tracking Technologies
We use cookies and similar technologies (such as pixels, tags, and local storage) in two categories. Strictly necessary technologies are required for the site to function and to keep it secure — for example, spam and abuse protection on our forms (currently Google reCAPTCHA). Optional analytics and advertising technologies (currently limited to Google Analytics) load only after you select “Accept” on our cookie banner; if you select “Decline” or take no action, no optional analytics or advertising technologies are loaded and no related requests are sent. Some pages let you launch embedded third-party services — such as appointment scheduling (currently Zocdoc) and informational videos (currently YouTube) — which load only when you click them and are then subject to those providers’ own privacy policies. We may add, remove, or change these technologies over time; any optional, non-essential technology will continue to load only with your consent. You can change your cookie choice at any time by clearing your browser’s site data for this website.
6. How We Share Information
We do not sell your personal information. We share website information only with service providers that help us operate the site and our practice, including: Google Analytics (analytics, only after consent); Google reCAPTCHA (form security); Zocdoc (appointment scheduling); YouTube/Google (embedded videos, only when you press play); and our SMS and client-portal providers. These providers may receive information such as your IP address, device identifiers, and usage data under their own privacy policies. We may also disclose information when required by law or to protect the safety of our clients, staff, or others. Any sharing of PHI is handled under HIPAA and New York law (see Section 3).
7. Your Privacy Rights and Choices
You may:
- Ask what personal information we hold about you, and request that we correct or delete website information;
- Withdraw consent for marketing communications at any time (reply STOP to texts);
- Decline or withdraw consent to optional analytics cookies.
We will respond to privacy requests within a reasonable period and as required by applicable law.
New York residents: we maintain reasonable safeguards for your private information under New York’s SHIELD Act and will notify you of a breach of that information as required by law (see Sections 10–11). Requests to access or amend your clinical record are handled under HIPAA and New York Mental Hygiene Law § 33.13 — please contact the office to make such a request. We do not collect, use, or disclose consumer health data except as reasonably necessary to provide requested services, operate our website, comply with legal obligations, or as otherwise permitted by law. We do not sell consumer health data. Where required by applicable law, we will obtain consent before collecting or sharing consumer health data.
California residents (to the extent CCPA/CPRA applies): you have the right to know, access, correct, and delete your personal information and to opt out of any “sale” or “sharing” of it. We do not sell your personal information, and we do not knowingly sell or share the personal information of anyone under 16. To opt out of optional analytics, select “Decline” on our cookie banner (see also Global Privacy Control, below). We will not discriminate against you for exercising your privacy rights.
8. Do Not Track / Global Privacy Control
We recognize Global Privacy Control (GPC) browser signals and treat them as a request to opt out of optional analytics technologies where applicable.
9. Children’s Privacy
We provide services to children and adolescents, but this website is intended to be used by adults (such as a parent or guardian). We do not knowingly collect personal information directly from children under 13 through this website without verifiable parental consent, consistent with the Children’s Online Privacy Protection Act (COPPA). Consistent with New York’s Child Data Protection Act, we do not knowingly process the personal data of a minor under 18 beyond what is strictly necessary to respond to a request the user initiates or as otherwise permitted by law; we do not sell minors’ personal data or use it for targeted advertising; and if we learn we have collected a minor’s personal data other than as permitted, we will delete it. Care for a minor, and any related consent, is arranged directly with a parent or legal guardian in accordance with New York law. If you believe a child has provided information through this website, please contact us and we will delete it.
10. Data Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information, consistent with New York’s SHIELD Act and, for PHI, the HIPAA Security Rule. This website is served over encrypted (HTTPS) connections. No method of transmission or storage is completely secure, so we cannot guarantee absolute security; please avoid sending sensitive health details through the website contact form.
11. Data Breach Notification
If a breach affects your private information, we will notify affected individuals (and any regulators, where required) in accordance with New York’s SHIELD Act and, for PHI, the HIPAA Breach Notification Rule.
12. Data Retention
We keep website information (such as contact-form submissions) only as long as needed for the purposes described here or as required by law, and then delete or de-identify it. Analytics data is retained only for the period necessary to evaluate website performance and security and is automatically deleted according to our configured retention settings. Clinical records are retained separately as required by New York law — generally for at least six years, and a minor’s records until at least one year after the minor reaches age 21 (see 8 NYCRR 29.2). We also retain certain HIPAA compliance documentation for at least six years, as required by federal law.
13. Third-Party Links and Services
Our website links to third-party services such as our client portal and Zocdoc. We are not responsible for the privacy practices of those services; please review their privacy policies before providing information.
14. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be posted on this page with a revised “Last updated” date above.
